Employer Consultation

Purpose

Employers in Canada can hire foreign workers if the LMIA process demonstrates that no Canadian citizen or permanent resident is available, willing, or qualified to fill a particular position. To obtain an LMIA and potentially interview Canadian residents or permanent residents, the position must be advertised for at least four weeks across specific platforms like the Job Bank. The company can then proceed with hiring a foreign worker only if the LMIA is positive.

Recruitment Requirements

Employers must conduct rigorous recruitment efforts, typically spanning a minimum of four weeks, across specific platforms (including the Job Bank) to prove inability to hire domestically.

Prevailing Wage

The offered wage must meet or exceed the median wage for the occupation in the specified geographic region as determined by Job Bank data.

Compliance Audits

Employers utilizing the Temporary Foreign Worker Program are subject to ESDC compliance reviews. Non-compliance can result in administrative monetary penalties (AMPs) or bans.
