"Section 25 of the Immigration and Refugee Protection Act allows the Minister to grant permanent resident status or an exemption from any applicable criteria or obligation of the Act, justified by humanitarian and compassionate considerations relating to the foreign national."

An H&C application is a highly discretionary, exceptional measure. It is designed for foreign nationals currently residing in Canada who do not meet the standard requirements for immigration classes but would face undue, undeserved, or disproportionate hardship if required to leave Canada.

Assessment Criteria

Officers evaluate H&C applications based on global factors, including:

  • Establishment in Canada (employment, volunteer work, community involvement).
  • Ties to Canada versus ties to the home country.
  • The best interests of any child (BIOC) directly affected by the decision.
  • Hardship associated with returning to the country of origin.
